Terms and Conditions for Online 1-to-1 Maths Tuition
These Terms and Conditions ("Terms") govern the provision of online 1-to-1 maths tuition services ("Services") by Beyond Maths ("Company") to the person to whom the introduction of a Tutor is made ("Client"). By engaging in the Services provided by the Employment Business, the Client agrees to be bound by these terms.
1. Acceptance of Terms
1.1 Upon using the services provided by the Company, the Client will be considered to have accepted these Terms.
1.2. Acceptance of these Terms will also be understood to signify acceptance of the Company's Privacy Policy.
2. Booking and Cancellation
2.1 The Client shall book their tuition sessions in advance by mutually agreeing upon a date and time with the Company.
2.2 Cancellation or rescheduling of a tuition session must be done at least 48 hours prior to the scheduled session. In case of cancellation within 48 hours, the Client will be charged at the standard rate for that session.
2.3 The Company reserves the right to change the lesson date or time in exceptional circumstances, and will communicate any changes with the Client as soon as reasonably possible.
3. Lateness
3.1 Tutors are expected to wait no longer than 15 minutes for a student to arrive. If a student is more than 15 minutes late, the tutors may leave the lesson and the Client will be charged in full.
4. Payment
4.1 Clients shall make payment for the Services in accordance with the pricing and payment terms agreed upon between the Client and the Company.
4.2 Payment for each tuition session is due prior to the session or as otherwise agreed upon between the Client and the Company.
4.3 The Company reserves the right to modify the pricing of its Services, provided that any changes will be communicated to the Clients in advance.
4.4 Payment for the Services must be made either through Teachworks via the Company's secure website or by direct transfer to the Company.
4.5 Clients shall not make payments directly to individual tutors. All payments must be made to the Company as specified in the payment instructions provided by the Company.
5. Termination of Services
5.1 If you receive regular weekly or bi-weekly tuition with the Company and wish to terminate lessons on a permanent or temporary basis, we require you to give notice to both the Company at hello@XXXX.co.uk and the tutor in writing by email before terminating lessons.
5.2 Our termination policy stipulates that upon providing notice to terminate lessons, you must schedule and attend one additional lesson with the tutor within 14 days of giving notice.
5.3 Failure to schedule or attend this lesson after giving notice of termination, or not responding to the tutor within 7 days, will be interpreted by the tutor as your indication of no longer wishing to continue tuition, and they may charge for this missed lesson.
5.4 If you do not provide any notice of termination, the tutor may charge for one session.
6. Intellectual Property Rights
6.1 All materials, including but not limited to lesson plans, worksheets, and instructional content, provided by the Company during the tuition sessions are protected by intellectual property rights and shall remain the sole property of the Company.
6.2 The Client is granted a limited, non-exclusive, and non-transferable licence to use the materials solely for the purpose of personal study and improvement during the term of their engagement with the Company.
7. Confidentiality and Privacy
7.1 The Company respects the privacy of its Clients and shall handle all personal information in accordance with applicable data protection laws and its Privacy Policy.
7.2 Clients are responsible for ensuring the security and confidentiality of their login credentials for the online platform and shall not share such information with any third parties.
8. Limitation of Liability
8.1 The Company will exercise reasonable care and skill in delivering the Services. However, the Company does not guarantee specific outcomes or results as a result of the tuition sessions.
8.2 The Company shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the provision of the Services.
8.3 The liability of the Company, whether in contract, tort, or otherwise, shall be limited to the total amount paid by the Client for the tuition sessions during the preceding three-month period.
9. Non-Solicitation
9.1 During the term of engagement with the Company and for a period of one year thereafter, Clients shall not directly engage or hire any tutor engaged by the Company for the provision of tuition services outside the scope of the Services provided by the Company.
9.2 Clients shall not attempt to solicit or engage any tutor engaged by the Company for their personal tuition needs without the express permission of the Company.
10. Severability
10.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
10.2 In the event that any provision of these Terms is determined to be invalid, illegal, or unenforceable, the parties shall negotiate in good faith to replace such provision with a valid and enforceable provision that achieves, to the extent possible, the original intent and economic effect of the invalid, illegal, or unenforceable provision.
11. Reviews
11. 1 You agree that any reviews of your time working with the Company will be directed towards Beyond Maths and not the tutor. This includes anytime a tutor asks you for a quote in an email as well as reviews on sites such as Trustpilot and Google.
Beyond Maths has its own review sites that we ask clients to use. Please contact the Company if you wish to leave a review.
12. Compliance with Laws and Regulations
12.1 The Company and the Clients shall comply with all applicable laws, regulations, and guidelines, including but not limited to those related to education, employment, data protection, and intellectual property.
12.2 The Clients are responsible for ensuring that their engagement in the Services provided by the Company is in compliance with any applicable laws, regulations, or requirements imposed by their educational institutions or governing bodies.
12.3 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
13. Entire Agreement
13.1 The Terms constitutes the entire agreement between the Company and the Clients regarding the provision of online 1-to-1 tuition and supersedes all prior agreements, understandings, and representations, whether oral or written.
13.2 The Company reserves the right to modify or amend these Terms and Conditions at any time. Any modifications or amendments shall be effective upon posting on the Company's website or notification to the Clients.
13.3 Clients are encouraged to review the Terms and Conditions periodically to ensure their continued compliance and understanding.
14. Governing Law and Jurisdiction
14.1 The Terms shall be governed by and construed in accordance with the laws of England and Wales.
14.2 Any disputes arising out of or in connection with the Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By engaging in the Services provided by Beyond Maths, the Clients acknowledge that they have read, understood, and agreed to these terms and conditions, including the Company's status as an Employment Business under the Employment Agencies Act 1973.
